Lietuvos nacionalinė vežėjų automobiliais asociacija „Linava“ kreipėsi į Lietuvos atstovus Europos parlamente ragindama palaikyti Lietuvos kelių transporto sektoriaus poziciją dėl Europos Komisijos inicijuojamos komandiruojamų darbuotojų direktyvos (Direktyva 96/71/EB) peržiūros. Šis klausimas bus svarstomas spalio 12 d. vyksiančioje tarpparlamentinėje diskusijoje Briuselyje, taip pat Europos Parlamento komitetuose, plenarinėje sesijoje ir kituose formatuose.
Pastaruoju metu suaktyvėjus senųjų ES valstybių narių protekcionistiniams veiksmams, pradėta ieškoti kelių, kaip pakeisti komandiruojamų darbuotojų veiklą reglamentuojančias taisykles. Šių iniciatyvų tikslas – apriboti naujųjų ES narių užimamą vietinės rinkos dalį, didinant krovinių gabenimo kaštus ir sukuriant papildomą administracinę naštą.
Pagal siūlomą naująją tvarką numatoma prievolė komandiruotiems darbuotojams taikyti iš esmės tokias pačias darbo užmokesčio ir darbo sąlygų nuostatas, kokios taikomos ekonomiškai stipresnių ES valstybių narių darbuotojams. Iniciatyvą aktyviai palaiko senosios ES valstybės narės (Vokietija ir Prancūzija jau priėmė atitinkamus nacionalinius įstatymus, planuojama priimti Italijoje), taip pat ES institucijos (2016 m. rugsėjo 14 d. Europos Parlamentas priėmė rezoliuciją dėl socialinio dempingo).
„Tai niekaip nesiderina su ES sutartyse numatytais vieningos rinkos bei laisvo prekių ir paslaugų judėjimo principais“,- pataikavimą senosioms ES šalims įžvelgia asociacijos „Linava“ prezidentas Erlandas Mikėnas.

Asociacijos „Linava“ nuomone, komandiruojamų darbuotojų veiklą reglamentuojančios taisyklės neturėtų būti taikomos transporto sektoriui dėl jo išskirtinai mobilaus darbo pobūdžio. Bendrųjų taisyklių taikymas transporto sektoriaus tarptautinių reisų vairuotojams, kiekvieną dieną teikiantiems paslaugos keliose skirtingose ES valstybėse narėse, yra nepagrįstas, negyvendinamas bei sukursiantis per didelę administracinę ir mokestinę naštą įmonėms bei atitinkamoms priežiūros institucijoms. Europos Komisija taip pat yra išsakiusi nuomonę, kad direktyva 96/71/EB neturėtų būti taikoma kelių transportui, tačiau dėl nuolatinio senųjų valstybių narių spaudimo EK pozicija gali keistis.
2016 m. gegužės mėnesį 11 ES valstybių narių (Lietuvos, Bulgarijos, Kroatijos, Čekijos, Danijos, Estijos, Vengrijos, Latvijos, Lenkijos, Rumunijos ir Slovakijos) parlamentai kreipėsi į EK dėl direktyvos 96/71/EB neatitikimo subsidiarumo principui. Tačiau EK sprendimu – pasiūlymas atitinka šį principą.
Lietuvoje transporto sektoriaus sukuriama bendroji pridėtinė vertė 2015 m. sudarė 13 proc. šalies BVP. Kelių transporto sektoriuje dirba 60 tūkst., susijusiuose sektoriuose – dar 160 tūkst. darbuotojų. Inicijuojamas pasiūlymas dėl direktyvos 96/71/EB turėtų didelės neigiamos reikšmės tolesniam kelių transporto sektoriaus vystymuisi, mažų ir vidutinių įmonių veiklai, taip pat visai šalies ekonomikai.
